2. The petitioner seeks bail in connection with Sasaram Nagar P.S. Case No. 1049 of 2022 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution case, 111 liters of foreign liquor was recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the recovery of illicit liquor was from one Ramashish Chaudhary and nothing has been recovered from the possession of the petitioner.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 11.10.2023.

6. Learned APP for the State vehemently opposed

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court-2-cum-Additional District and Sessions Judge, Rohtas at Sasaram/ concerned Court below in connection with Sasaram Town P.S. Case No. 1049 of 2022.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Sasaram Nagar Police Station on every Sunday of the month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
