The petitioner apprehends his arrest in Amour P.S. Case No. 124/2017, registered for the offences punishable under Sections 147, 148, 149, 323, 354, 380, 452 and 364A of the Indian Penal Code.

The prayer for bail of petitioner was earlier rejected vide order dated 02.08.2018 passed in Cr. Misc. No. 34451/2018. This is the second attempt. The petitioner has come second time on the ground that victim boy has returned and has given his statement under Section 164 Cr.P.C. This court finds that earlier bail application was rejected on 02.08.2018 on merit. The statement of victim has been recorded on 11.09.2018 which is subsequent event.

Patna High Court Cr.Misc. No.73861 of 2018(2) dt.19-12-2018 2/2 Therefore this court is not inclined to grant anticipatory bail to petitioner. The anticipatory bail petition is rejected.

The petitioner is directed to surrender in the court below and make prayer for regular bail within a period of eight weeks from the date receipt of this order which will be disposed of by court below in accordance with law.
