2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 147, 148, 149, 447, 341, 323, 324, 307, 427, 354B, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, the allegation against the petitioner is of assaulting the husband of the informant by means of farsa, due to which he sustained cut injuries on his head and he fell down. It is further alleged that petitioner snatched his gold chain worth Rs. 80,000/-. Other accused persons have also assaulted the informant and his family members by various weapons.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to
Patna High Court CR. MISC. No.5094 of 2024(2) dt.07-02-2024 2/2 dirty village politics. Old land dispute is going on between the parties. There was free fight between them and members of both sides have received injuries in the alleged occurrence. General and omnibus allegation has been levelled against the petitioner. Petitioner is languishing in judicial custody since 12.10.2023.
5. The application for bail is opposed by learned APP for the State and learned counsel for the informant and submitted that Petitioner is named accused and he has assaulted the informant's husband by means of farsa on his head. .
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran at Motihari concerned in connection with Turkauliya P.S. Case No. 1002 of 2023.
