JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-01-2020 Heard Ms. Bela Singh, learned counsel appearing on behalf of petitioner and learned counsel appearing for the State. The present application has been filed for modification of the order dated 30.09.2019 passed in Cr. Misc. No.41633 of 2019 to the extent that the time granted for surrender of the petitioner be extended by further two weeks. Learned counsel for the petitioner submits that as per the terms of the order, the petitioner was required to pay a sum of Rs.70,000/- at the time of surrender and due to some unavoidable reasons, the amount could not be arranged within eight weeks, and therefore, the petitioner could not surrender

Patna High Court CR. MISC. No.81976 of 2019(2) dt.22-01-2020 2/2 before the learned Court below inasmuch as per the order, the petitioner was required to attach the proof of making payment of Rs.70,000/- to Opposite Party No.2 positively along with his surrender-cum-bail application. Learned counsel for the petitioner further submits that now the money has been arranged and the petitioner will be handing over a sum of Rs.70,000/- to Opposite Party No.2 and acknowledgment of the same will be attached along with surrender-cum-bail application within a period of two weeks from today.

After having heard learned counsel for the petitioner and taking into consideration the statement made in the modification application, I am inclined to extend the time as granted vide order dated 30.09.2019.

Accordingly, the order dated 30.09.2019 is modified to the extent that the time for surrender is extended by further two weeks from today and the time for making payment is also extended by the same period from today.
