Mr. Tarun Prasad Mandal , APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-03-2024 At the outset, it is submitted that the bail petition of the petitioner No. 1 has already been withdrawn vide order dated 31.01.2024 .

2. Heard learned counsel for the petitioner Nos. 2 and 3 and the State.

3 . Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 302 and 34 of the Indian Penal Code.

4. As per the prosecution case , the sister of the informant Reena Devi in 2006 solemnized marriage with coaccused Manoj Sharma as per Hindu rituals. It is further alleged

No.2746 of 2024(3) dt.07-03-2024 2/3 that after some days of marriage these petitioners along with other co-accused persons started torturing and harassing her for the demand of dowry and due to non-fulfillment of the demand of dowry she was killed by the accused persons. 5 . It is submitted on behalf of the petitioners that petitioner No. 1 is father-in-law and Petitioner No. 2 is motherin-law of the deceased. They are separate in mess and property. There is no specific allegation of overt act alleged against them and they have no concern with the couple. It is further submitted that thrust of accusation is against husband of the deceased who is already in custody and this fact has been stated in the supplementary affidavit, which is said to have been filed by learned counsel of the petitioners on 26.02.2024 . Petitioners claim clean antecedent.

6. Learned counsel for the State opposes the bail petition .

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let this petitioner Nos. 2 and 3 , as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate - 1st
