JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with Gopalpur P.S. case No. 437/2018 registered for the offences punishable under Sections 366A/34, 364 of the Indian Penal Code and Section 4 of the P.O.C.S.O. Act.

The victim has, specifically, stated in her statement recorded under Section 164 of the Code of Criminal Procedure that she was allured by the petitioner and, subsequently, she was made captive at Delhi, where petitioner committed rape on her.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release

Accordingly, prayer for bail of the petitioner stands rejected.

However, petitioner may renew his prayer for bail, if the trial of the petitioner is not concluded within six months from the date of receipt / production of a copy of this order from the court concerned.
