ANJANA MISHRA ORAL ORDER 06-12-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioner apprehend their arrest in connection with Kharik P.S. Case No. 133/2019 registered for the offence punishable under Sections 414 of the Indian Penal Code. Learned counsel for the petitioners submits that the name of the petitioners have surfaced in the confessional statement made before the police by one Sanjay Kumar who is said to have been arrested along with the motorcycle in question and that he has disclosed the names the present petitioners. It is further submitted that the petitioners have been implicated only due to enmity and grudge and their prosecution is based purely on suspicion Considering the aforementioned facts and

No.80193 of 2019(2) dt.06-12-2019 2/2 circumstances and that no recoveries have been made from the possession of these petitioners and they are having no criminal history, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, 1st Naugachia, Bhagalpur, in connection with Kharik P.S. Case No. 133/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
