====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 10-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Pipariya P.S. Case No. 29 of 2025 , registered for the offences under Sections 126(2), 115(2), 109(1), 352, 351(2), 3(5) of the BNS.

3. As per the prosecution case, the petitioner and coaccused Dipu Singh assaulted the informant with lathi on his head causing its fracture. Other co-accused persons joined them and looted the shop of the informant and assaulted his family members.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The FIR has been lodged after a

Patna High Court CR. MISC. No.85065 of 2025(2) dt.10-12-2025 2/3 delay of two days for which there is no explanation which shows the falsity of the allegation. Learned counsel further submits that the present case is counter blast of Pipariya P.S. Case No. 26 of 2025 which has been lodged for the occurrence of same date i.e. 15.03.2025. The said case was instituted on the written report of the uncle of the petitioner against a number of person of the informant's side as they assaulted the uncle of the petitioner and in order to create a defense, the present case has been lodged. The allegation of assault on the informant is against the petitioner and co-accused and it is non-specific. The injury report shows only lacerated wound over the parietal region of the skull for causing of which the allegation is against two persons and the injury is simple in nature. The petitioner is in custody since 24.10.2025 and he has one criminal antecedent in which he is on bail. Charge sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the earlier lodged case of the petitioner side and also considering the period of custody and submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail

Patna High Court CR. MISC. No.85065 of 2025(2) dt.10-12-2025 3/3 bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned JMFC, Lakhisarai/concerned court, in connection with Pipariya P.S. Case No. 29 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
