In this case, the petitioners are seeking bail in connection with G.O. Case No.1052 of 2019, arising out of Laheriasarai P.S. Case No.434 of 2019 registered for offence punishable under sections 272, 273, 414/34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It has been alleged that 20 litres of liquor has been recovered from the possession of the petitioners and they in custody since 18.10.2019.
Looking to the facts and circumstances of the case,
Patna High Court CR. MISC. No.78687 of 2019(2) dt.04-12-2019 2/2 the prayer for bail of the petitioners is allowed and they are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge (Excise), Darbhanga in connection with G.O. Case No.1052 of 2019, arising out of Laheriasarai P.S. Case No.434 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. If the petitioners are found involved in similar type of offence, the relief granted to the petitioners in the present case will be treated to have been withdrawn.
