JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Uchakagaon P.S. Case No. 41/2017, registered for offences punishable under Sections 366(A)/376 of the Indian Penal Code and 8/9/10 of the POCSO Act, 2012.

Allegation as per F.I.R., there is allegation against the petitioner of kidnapping the minor daughter of the informant. It has been submitted on behalf of the petitioner that girl is major and in trial, she has appeared and not supported the case of prosecution, which will appear from annexure -2 and. Further submission is that petitioner has no criminal antecedent and he has been in judicial custody since 07.05.2019 and ready to abide by any condition imposed on him Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let

Patna High Court CR. MISC. No.80129 of 2019(2) dt.13-01-2020 2/2 the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Gopalganj, in connection with Uchakagaon P.S. Case No. 41/2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
