2. The petitioner seeks bail in connection with Chakmehsi P.S. Case No. 159 of 2023 registered for the offence punishable under Sections 341, 323, 376(D) of the Indian Penal Code and Sections 4 and 6 of the POCSO Act and Sections 3(I) (V)(2) of the SC/ST Atrocity Act.

3. The petitioner and others are said to have sexually assaulted the victim. In the medical report, no external injury has been found and there is no sign of any sexual assault. The petitioner is a student of Agriculture in Allahabad. The petitioner is in jail since 18.03.2024.

4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

5. Considering the aforesaid and the period of custody, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Court (POCSO), Samastipur/ concerned Court in connection with Chakmehsi P.S. Case No. 159 of 2023, subject to the condition that the petitioner will co-operate in the trial.
