JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 Petitioner apprehends his arrest in connection with Runnisaidpur P.S. Case No. 268 of 2018 registered for the offences punishable under Sections 376, 366A, 313 and 315 of the Indian Penal Code.

Allegation against the petitioner is that he has developed physical relationship with the complainant/informant on the pretext of marriage and she became pregnant and her pregnancy was aborted by the petitioner.

Submission of learned counsel for the petitioner is that complaint petition itself shows that she was major and she was consensual party and only to pressure upon the petitioner this false case has been lodged.

Patna High Court Cr.Misc. No.73627 of 2018(3) dt.25-01-2019 2/2 Heard learned APP and learned counsel for the informant also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 268 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
