Sinha, learned Senior Advocate for the Informant as well as learned Nitya Nand Tiwary, learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Harnaut (Kalyan Bigha) P.S. Case No. 244/2019 registered for the offences punishable under Sections 447/504/341/323/ 307/379/34 of the Indian Penal Code.

The allegation against both the petitioners is of hitting him on his head and on his hand.

In these circumstances, I am not inclined to grant anticipatory bail to petitioner No. 2 (Sujeet Kumar).

Patna High Court CR. MISC. No.82104 of 2019(7) dt.03-11-2021 2/2 The prayer for grant of anticipatory bail of petitioner No. 2 (Sujeet Kumar) is hereby rejected.

So far as petitioner No. 1 (Ajit Kumar) is concerned, he is allowed anticipatory bail only because of the fact that he is a Central Government employee.

In view of the aforementioned facts and circumstances, let the petitioner No. 1 (Ajit Kumar) be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda, (Biharsharif) in connection with Harnaut (Kalyan Bigha) P.S. Case No. 244/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. However, if the petitioner surrenders before the Court below within four weeks from today, the Court below shall consider his prayer for regular bail without being prejudiced by the fact that his prayer for anticipatory bail has been rejected by this Hon'ble Court.
