JUSTICE BIRENDRA KUMAR ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323,420 and 504 of the Indian Penal Code.

Complainant had purchased a land from the petitioner which subsequently revealed to be of some other person(Nagina Kumar).

Learned counsel for the petitioner submits that petitioner is ready to refund the total consideration money of Rs.2,07,000/- in eight equal installments starting from January, 2020.

Considering the undertaking of the petitioner

No.81365 of 2019(2) dt.18-12-2019 2/2 made in presence of learned counsel for the complainant, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Complaint Case No.291 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

If the petitioner would fail to fulfill his undertaking, the learned court below shall be at liberty to cancel the bail bond of the petitioner. Petitioner shall refund the money through the account payee cheque/bank draft/ R.T.G.S. and not in cash.
