JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-03-2020 The petitioner, who is in custody since 14.11.2019 seeks bail in connection with Excise Case No. 252 of 2019, instituted for the offence under Section 30 (a) of Bihar Prohibition of Excise Act, 2018. It is alleged that from the vehicle which was being driven by the petitioner, 1946 litres of liquor was recovered.

Learned counsel for the petitioner submits that he was unaware of the contents of the consignment which he was transporting. The petitioner is the driver of the vehicle in question and has clean antecedents. Considering this aspect of the matter and the period of custody of the petitioner in the present case, he is directed to be released on bail on his furnishing bail

Patna High Court CR. MISC. No.79421 of 2019(4) dt.06-03-2020 2/2 bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge Excise, Bhagalpur in connection with Excise Case No. 252 of 2019.

The application stands allowed.
