This application for anticipatory bail arises out of Simri P.S. Case No. 219 of 2018, disclosing offences under Sections 420, 467, 468, 471, 120(B) and 506 of the Indian Penal Code.
It is alleged that the informant's wife fraudulently executed sale deeds in respect of property which the informant had inherited. It is also alleged that it has been done under the conspiracy and with the connivance of all the persons named in the first information report. Informant's wife is also accused in that first information report. The petitioner is said to be purchaser of a piece of land. Petitioners have been implicated on
Patna High Court Cr.Misc. No.73214 of 2018(2) dt.20-12-2018 2/2 the ground that they have purchased the land fraudulently through the sale deeds executed by the informant's wife. Learned counsel for the petitioner submits that a civil dispute given tinge of a criminal case.
Be that as it may, in view of nature of allegation against each petitioner, this application is allowed. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned A.C.J.M. IV, Buxar, in Simri P.S. Case No. 219 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
