ANJANA MISHRA ORAL ORDER 10-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 01.07.2019, in connection with Phulwarisharif P.S. Case No. 635 of 2019 (Special Case No. 68 of 2019) for the offences under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act and Section 20 & 22 of N.D.P.S. Act. Learned counsel for the petitioner submits that as alleged in the FIR only 2 gms of smack is said to have been recovered from the possession of the petitioner. However, learned counsel for the petitioner submits that no such recovery was made but the same has been saddled on his shoulders. It is further submitted that one co-accused Md. Meenu Iqbal has since been extended the privilege of bail in Cr.Misc. No. 63879

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Patna in connection with Phulwarisharif P.S. Case No. 635 of 2019, Special Case No. 68 of 2019.
