The petitioner seeks bail in Maker P.S. Case No.167 of 2019 registered for offence punishable under Sections 399/402 of the Indian Penal Code, Section 37 (B) © of Bihar Prohibition and Excise Act and Section 25 (1-B)a, 26, 35 of the Arms Act.

Allegation has been made that the accused persons along with this petitioner were gathered after drinking wine for committing dacoity on the National Highway and the police has recovered different articles, firearms etc. from the different coaccused persons. Counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner and he is in

Patna High Court CR. MISC. No.78981 of 2019(2) dt.04-12-2019 2/2 custody since 19.10.2019 having clean antecedent. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Saran at Chapra in connection with Maker P.S. Case No.167 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court/prosecution would be at liberty to take steps for cancellation of his bail bonds.
