JUSTICE ANIL KUMAR SINHA ORAL ORDER 03-01-2023 It is an admitted position between the parties that a compromise decree was passed in Partition Suit No. 47/1952 and the Respondent No. 5 being aggrieved by the same has filed a Miscellaneous Case under Order 23A Rule 1 CPC bearing Miscellaneous Case No. 06/2016.

The contention between the parties is with regard to mutation of the subject land and as per the order passed by

Patna High Court CWJC No.24245 of 2018(3) dt.03-01-2023 3/3 revisional authority mutation stands in the name of the Respondent No. 5.

Be that as it may, this writ application is disposed with a direction to Sub Judge 1st/ Successor Court, Begusarai to decide the Miscellaneous Case No. 06/2016 in accordance with law and on its own merit within a reasonable time frame. It is made clear that the mutation order, if any, shall be subject to the final outcome of the Miscellaneous Case decided by the Civil Court.
