The petitioner seeks regular bail in connection with Kudra P.S. Case No. 290 of 2019 for the offence registered under Sections 393 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The allegation is regarding the Police having received secret information that some miscreants were planning to commit dacoity/ theft of animals and a Bolero Pick Up van was seized by the villagers whereafter the Police had arrived at the place of occurrence and arrested the petitioner and two other co-accused persons. As far as the petitioner is concerned, one mobile phone is said to have been recovered while one country made pistol was recovered from the co-accused person,

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted that the petitioner is languishing in custody since 07.09.2019. Lastly, it is submitted that as far as the petitioner is concerned, there is no allegation of recovery of any illegal arms. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Bhabua at Kaimur in connection with Kudra P.S. Case No. 290 of 2019.
