At the very outset it is submitted on behalf of the petitioner that the processes under Section 82 of the Cr.P.C. has already been issued against the petitioner, which appears from the case diary.

Having heard both sides and in view of the facts and circumstances, let the petitioner surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record, without being prejudiced by the order of this Court. With the aforesaid observation, this application is disposed of.
