JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 A supplementary affidavit has been filed during the course of arguments. Let it be taken on record. The petitioner, who is custody since 27.09.2019, seeks bail in connection with Katra P. S. Case No. 165 of 2019 dated 14.07.2019 instituted for the offence under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016.

Approximately 3955.12 litres of liquor is said to have been recovered from three different places. The name of the petitioner has transpired in the statement of a Chaukidar. The petitioner earlier had been made

Patna High Court CR. MISC. No.78709 of 2019(3) dt.17-03-2020 2/2 accused in several cases but in all such cases, he is on bail except in two of such cases where he has not been named and has not also been remanded.

Considering the period of custody of the petitioner and taking into account that one of the accused with similar allegation has been granted bail by a Bench of this Court on 28.11.2019 in Cr. Misc. No. 77541 of 2019, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Muzaffarpur in connection with Katra P. S. Case No. 165 of 2019.
