In this case, the petitioner is apprehending his arrest in connection with Excise Case No. 154 of 2019 registered for offences under sections 30(a) (c) of the Bihar Prohibition and Excise Act, 2016.

As per allegation, the police has recovered 52 liters of illegal Chulai liquor from the land of the petitioner. Learned counsel for the petitioner submits that the petitioner has no concern with the alleged offence and has falsely been implicated in the present case.

Looking to the quantity of liquor recovered as also considering the entire facts and circumstances of the case, this

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law preferably on the same day of his appearance.
