2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 305 and 331 (4) of the BNS.

3. 3. The case of the prosecution in short is that three unknown miscreants entered in the house of the informant and committed theft and valuable articles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the FIR was lodged against unknown miscreants. The name of this petitioner has surfaced in the confessional statement of the coaccused persons. It is further submitted that nothing has been

Patna High Court CR. MISC. No.84021 of 2025(2) dt.12-12-2025 2/2 recovered from the possession of this petitioner. Save and except the confessional statement of the co-accused, nothing is against the petitioner. Moreover, the petitioner is languishing in judicial custody since 02.08.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of 12 cases.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bhagwan Bazar P.S. Case No. 598 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saran at Chapra.
