====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 04-12-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Huge quantity of liquor was recovered from the vehicle of which the petitioners were driver and cleaner. In the past, prayer for bail was refused on 08.05.2019 in Cr. Misc. No. 30260 of 2019, with liberty to renew prayer if the trial is not concluded within six months. Submission is that trial has not concluded.

Considering the aforesaid facts, let the petitioners,

Patna High Court CR. MISC. No.78819 of 2019(2) dt.04-12-2019 2/2 above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dumariya Ghat Police Station Case No. 36 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
