====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-12-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence registered under Sections 302 and 201/34 of the IPC. The prosecution story, in brief, is that the petitioner killed the father of the informant and dragged away and kept the dead body secretly near a Septic Tank.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 25.06.2019. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The name of the petitioner has come in the present case merely on the basis of suspicion as the dead body was

Patna High Court CR. MISC. No.78284 of 2019(2) dt.02-12-2019 2/2 found nearby the house of the petitioner. Except for this, there is no substantive evidence to suggest the implication of the petitioner in the present case. There is no eye witness to the alleged occurrence.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Saharsa, in connection with Sour Bazar (Patarghat O.P. ) P.S. Case No. 230 of 2019.
