Petitioner apprehends his arrest in Jalalgarh P.S. Case No.7 of 2018 registered under Sections 379 and 413 of the Indian Penal Code, under Section 40 of the Bihar Minor Mineral Concession Rules, 1972 and Section 15 of the Environment (Protection) Act, 1986.
The gist of the allegation is that the petitioner was running a brick kiln without paying the tax amounting to Rs.74,000/- and odd and also without obtaining environment clearance certificate.
Learned counsel for the petitioner submits that the District Mining Officer, Purnea issued letter no.897 on 19.09.2018 after receiving Rs.74,500/-. The petitioner did not evade payment of any tax.
