2. The petitioner is apprehending his arrest in connection with Sugauli P.S. Case No. 260 of 2023 registered for the offence punishable under Sections 447, 341, 342, 323, 354B, 504, 34 of the Indian Penal Code and Section 8 of the POCSO Act.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.2690 of 2024(4) dt.16-04-2024 2/2 learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day considering the fact that the petitioner has no criminal antecedent. Learned counsel below is also directed to consider the Apex Court judgment in the case of Satendra Kumar Antil Vs. Central Bureau of Investigation & Anr. reported in (2022) 10 SCC 51 and in the case Arnesh Kumar Vs. State of Bihar reported in (2014) 8 SCC 273.
