JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 The petitioner seeks regular bail in connection with Khaira P.S. Case No. 116 of 2019, registered for offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of firing on the son of informant causing his death on the spot.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner and he has falsely been implicated in this case and has been in judicial custody since 07.05.2019.

Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for bail. Learned counsel for the informant has submitted that altogether nine

Patna High Court CR. MISC. No.79458 of 2019(3) dt.10-01-2020 2/2 injuries were found on the person of the deceased and allegation against the petitioner also of firing and considering the same, a coordinate Bench of this Court vide order dated 22.08.2019 passed in Cr. Misc. No. 51515 of 2019 has rejected the prayer of bail of one of the accused persons.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.

This application is accordingly dismissed.
