2. The petitioners seek regular bail in connection with Gopalpur (Rangra) P.S. Case No. 432 of 2023, lodged on 06.09.2023 under Section 392 of the Indian Penal Code.

3. As per the prosecution case, FIR has been lodged against three unknown accused persons against whom there is an allegation that they looted a sum of Rs. 99,600/- which was kept in a bag in the dicky of the motorcycle of the informant.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel also submits that the name of the petitioners have been figured in this case only by virtue of confessional statement of

No.5317 of 2024(2) dt.07-02-2024 2/3 the co-accused and it has been alleged that Rs. 3,600/- was recovered from the possession of petitioner no.1 and Rs. 950/- was recovered from the possession of petitioner no.2. Counsel further submits that neither TIP of the person or property took place.

5. Learned counsel for the petitioners submits that the antecedent of the petitioners are clean and they are in custody since 22.09.2023.

6. Learned counsel for the petitioners submits that the offence in which the case has been filed is of magisterial triable.

7. Learned APP for the State opposes the prayer for bail of the petitioners.

8. In the present facts and circumstances of this case and the submissions made above considering the antecedent of the petitioners, let the petitioners above named, be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Naugachia, in connection with Gopalpur (Rangra) P.S.
