Petitioners are apprehending their arrest in connection with Wazirganj P.S.Case No.283 of 2018 , registered for offences punishable under Sections 323, 504, 506, 307, 34 dated 1.9.2019 vide Gr. No.6289 of 2018 of the Indian Penal Code.
As per FIR, there is allegation against the petitioner no.1 that they have assaulted the son of the informant and there is also allegation against one Samsher that he assaulted by Khant .
Submission of the learned counsel for the petitioners is that the occurrence took place due to scuffle between the
Patna High Court CR. MISC. No.3375 of 2019(5) dt.13-12-2019 2/2 children of the parties. FIR does not disclose by which weapon the petitioners have assaulted rather there is allegation of assault by Khant by one Samsher. There is also case and counter case between the parties.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM I , Gaya in connection with Wazirganj P.S.Case No.283 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
