2. In this case, the petitioner is seeking regular bail in connection with S.T. No. 198 of 2024 arising out of Kotwali P.S. Case No. 1028 of 2023 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
3. As per allegation, when the informant was returning to his house, the F.I.R. named accused persons including the petitioner abused and assaulted him. The specific allegation against the petitioner is to inflict knife blow on the stomach of the informant whereby he became badly injured.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.87797 of 2024(2) dt.28-02-2025 2/2 that it is true that injuries suffered by the informant is grievous in nature but the petitioner is under custody for a period of more than one year.
5. On the other hand, the learned APP for the State, Sri Binod Kumar No. 3 has opposed the prayer for bail by submitting that the petitioner is the assailant who has stabbed the injured in his stomach.
6. Considering the above-mentioned facts and circumstances, the period of incarceration, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge X, Bhagalpur in connection with Kotwali P.S. Case No. 1028 of 2023, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
