2. The petitioner seeks bail in connection with Dagarua P.S. Case No. 285 of 2023 registered for the offence under Sections 341, 323, 307, 504, 506/34, 379 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is said to have fired upon the victim.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. Learned counsel for the petitioner further submits that the petitioner, without accepting his guilt undertakes to pay Rs. 25000/- to the informant of this case and for the same he has produced a Demand Draft of Rs. 25000/- in the Court.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 17.09.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Dagarua P.S. Case No. 285 of 2023.

9. As a condition of this order, the petitioner is directed to produce the Demand Draft of Rs. 25000/- in the Court below at the time of furnishing his bail bonds and the same shall be released in favour of the informant by the Court below.
