ANJANA MISHRA ORAL ORDER 05-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with G.O. Case No.968 of 2019 arising out of Keoti P.S. Case No.141 of 2019 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner and the alleged recoveries were from the septic tank of Hari Yadav and the petitioner has nothing to do with the same.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his

No.79788 of 2019(2) dt.05-12-2019 2/2 arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge Cum Special Judge (Excise Act), Darbhanga, in connection with G.O. Case No.968 of 2019 arising out of Keoti P.S. Case No.141 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
