JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This is an application for grant of anticipatory bail in connection with Samastipur (Muffasil) P. S. Case No. 492 of 2019, disclosing offences under Sections 18(c), 27(b)(ii) of Drugs and Cosmetics Act, 1940 and Section 420 of IPC. As per F.I.R. during the suspension period of the license of the petitioner, he was selling the drugs from his shop. Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is shop owner and there is no chance of absconding and he is ready to abide by any condition imposed upon him.

Heard learned A.P.P. also.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.85700 of 2019(2) dt.22-01-2020 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Additional Sessions Judge-I-cum- Special Judge, Samastipur, in connection with Samastipur (Muffasil) P. S. Case No. 492 of 2019 with condition to co-operate in the investigation and appear before the police as and when required, otherwise, his bail bonds shall be cancelled.
