The petitioners are apprehending their arrest in connection with Nauhatta P.S.Case No.106 of 2018 dated 6.7.2018 , registered for offences punishable under Sections 363, 366(A), 34 of the Indian Penal Code.
Allegation against the petitioners is of kidnapping of the minor daughter of the informant.
Submission of the learned counsel for the petitioners is that the statement of the girl has been recorded under Section 164 Cr.P.C. in which she has disclosed her age as 20 years and further stated that she has married with one Md. Azmer and no force was used.
Heard learned A.P.P. also.

No.1638 of 2019(2) dt.24-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Nauhatta P.S.Case No.106 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case.. With the aforesaid observation, this application is allowed.
