The petitioner has filed the instant application for grant of bail in a case registered for the offence under section 420 of the Indian Penal Code.

As per the allegation in the complaint, the complainant and the husband of the petitioner entered into an agreement that they would purchase the land of equal area from the other accused namely, Md. Akmal. It is further stated that the husband of the petitioner cheated the complainant of his money and got the total area of land transfer by a registered deed in favour of his wife.

No.78797 of 2019(2) dt.03-12-2019 2/2 It is submitted by learned counsel for the petitioner that the petitioner is a lady, from reading of the complaint it would be evident that there is no allegation against her and the dispute is purely of civil nature. It is further submitted that the petitioner has no criminal antecedent.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on her furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Araria in connection with Complaint Case No. 2607C of 2018.
