Petitioner seeks pre-arrest bail in connection with Laheri P.S. Case No. 437 of 2017 registered under Sections 406 and 420 of the Indian Penal Code.

Learned counsel appearing on behalf of petitioner and opposite party no. 2 submits that out of court petitioner and opposite party no. 2 have settled their dispute amicably on agreement of the petitioner to return the Tractor to opposite party no. 2 and also to give Rs.1.65 lakhs.

In view of the submissions of the learned counsel for the petitioners and opposite party no. 2 that since the petitioner is ready to return the tractor to opposite party no. 2 and also to give Rs. 1.65 lakhs in cash within two months, hence opposite

Patna High Court CR. MISC. No.74005 of 2018(7) dt.22-07-2019 2/2 party no. 2 has no objection in allowing pre-arrest bail to the petitioner.

Having heard both sides, let petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount is to the satisfaction of Chief Judicial Magistrate, Nalanda, in Laheri P.S. Case No. 437 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
