Petitioner seeks bail in Sessions Trial No.567 of 2018 arising out of Baikunthpur P.S. Case No.159 of 2018 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.
Counsel for the petitioner submits that marriage has taken place in the year 2008 and death has taken place in 2018. The police after investigation has submitted charge-sheet under Section 302 Indian Penal Code.
In the written report, it is alleged that deceased was married with this petitioner in the year 2008. She was tortured in her Sasural for golden chain. It is alleged that on 17.06.2018 the informant took his daughter to Sasural and she was living there.
Patna High Court Cr.Misc. No.74454 of 2018(3) dt.11-01-2019 2/2 The informant has stated in the written report that all the family members including the petitioner have committed murder of his daughter in Sasural on 22.06.2018 and got the dead body disappeared.
Case diary has been received. In the entire case diary, there is no eye witness. The informant and other witnesses have levelled general and omnibus allegation against the petitioner. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge VIII, Gopalganj, in connection with Sessions Trial No.567 of 2018 arising out of Baikunthpur P.S. Case No.159 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
