In this case, the petitioner is seeking bail in connection with Jehanabad Rail P.S. Case No.44 of 2019 registered for offence punishable under section 379 of the Indian Penal Code and section 411 of the Indian Penal Code has been added later on.
In the FIR it has been alleged that some miscreants snatched the mobile phone from the passenger running in Patna-Hatia Express in Coach No. S-5 and the said mobile has been recovered from the house of the petitioner. The petitioner as a joint house. The said mobile was purchased by the brother of the petitioner. The petitioner has one criminal history under Excise Act. He is in jail since 11.09.2019.

No.79068 of 2019(2) dt.04-12-2019 2/2 Looking to the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Railway Magistrate, Railway Court, Gaya in connection with Jehanabad Rail P.S. Case No.44 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
