1. The petitioners have filed the instant application for the following reliefs:

(i) this Hon'ble High Court may be graciously pleaded to direct the respondents-authorities to pay appropriate accidental death compensation to the petitioner in accordance with law, because father of

2/4 the petitioner namely Shiv Shankar Singh constable, Bihar Home Guard, Buxar was died due to electric shock when he was returning after performing his security duty due to fell down High Voltage of Electric Wire on the way.

(ii) Any other reliefs may be allowed under facts and circumstances of this case in accordance with law for which dependent of petitioner is duly entitled.

2. A detailed counter affidavit was filed by the respondents stating that already an amount of Rs. 4,00,000/- has been paid to the petitioner.

3. The Learned counsel for the respondents further contended that since this matter is squarely covered under the order dated 26.06.2024 passed in CWJC No. 17625 of 2016 (Lalmuni Devi Vs. The State of Bihar & Ors.) by this Court in which this Court has passed the order in light of the judgment passed by the Hon'ble Apex Court in the case of Power Grid Corporation of India Vs. Century Textiles reported in 2017(2) PLJR (SC) 152, this writ

3/4 petition may also be disposed of on the same terms and conditions.

4. After perusal of the aforesaid judgment, the Learned counsel for the petitioner seeks liberty to file appropriate application for compensation before the concerned Civil Court.

5. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

6. Having regard to the submissions made by the learned counsel for the petitioner, the present writ petition stands disposed of in terms of the aforesaid judgment passed in CWJC No. 17625 of 2016 (supra) with liberty to the petitioner to seek necessary compensation by approaching the concerned Civil Court. The petitioner shall file such application within a period of four weeks from the date of receipt of copy of this order, the same shall be examined and disposed of by the appropriate court as expeditiously as possible.

7. With the aforesaid direction the writ

8. Interlocutory Application, if any, shall stands disposed of.
