2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304(b)/34 of the Indian Penal Code.

3. The case of the prosecution, in short, is that the daughter of the informant, namely, Babita Kumari was married to Suraj Basfor (the petitioner herein). It is alleged that after marriage, the deceased was subjected to cruelty on account of non-fulfillment of demand of dowry of motorcycle and that she was ultimately killed.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that

Patna High Court CR. MISC. No.86956 of 2025(2) dt.12-01-2026 2/3 earlier the anticipatory bail petition of the petitioner was rejected vide order dated 23.04.2025 passed in Cr. Misc. No. 19526 of 2025. It is further submitted that during the course of trial, the informant himself has not supported the prosecution case and has categorically deposed that the petitioner had informed him about the death of the deceased and that the relationship between the deceased and the petitioner was cordial. He was further stated that the deceased was never subjected to cruelty, no demand of dowry was ever made and he does not know how the deceased died. The informant further stated that he was informed about the occurrence by the villagers. It is further submitted that the wife of the petitioner has also exonerated him from the allegation. It is contended that at the time of the alleged occurrence, the petitioner was not present at the place of occurrence. It is lastly submitted that the petitioner is languishing in judicial custody since 15.01.2025 having no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on
