====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 191(2), 118(1), 103(1), 351(2) and 352 of the B.N.S., 2023.

3. As per the prosecution case, Gautam Yadav @ Gautam Kumar assaulted on the head of the deceased with a lathi, as a result of which she subsequently died.

4. Learned counsel for the petitioner submits that there is no specific allegation of any assault or overt act attributed to the petitioner; rather, there is only general and omnibus allegation against him. The specific allegation of assault is against the co-accused, Gautam Yadav. The petitioner is in custody since 08.08.2025 and the charge-sheet has been

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Belhar P.S.
