2. The petitioner seeks regular bail in connection with Raghopur P.S. Case No. 254 of 2024, registered for the offence under Section 309(4) of the Indian Penal Code.

3. As per the prosecution case, unknown criminals on a gun point looted the informant's three mobile phones, Rs. 7,000/- as cash and Aadhar Card. Two mobile phones have been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 28.07.2024. Petitioner has criminal antecedent.

5. Learned A.P.P. has vehemently opposed the prayer

Patna High Court CR. MISC. No.87475 of 2024(2) dt.18-01-2025 2/2 for bail and has submitted that the cover of the mobile phone has been recovered from the possession of the petitioner.

6. Considering the fact that the cover of the mobile phone which was looted from the informant has been recovered from the possession of the petitioner, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed. The Court below is directed to expedite the trial of the petitioner. (Sandeep Kumar, J) Shishir/- U T
