Counsel for the petitioner submits that the present case has been filed for directing to pay the difference of salary on the ground of grant of 3rd MACP to the petitioner w.e.f. 01.01.2009 by Civil Surgeon-cum-Chief Medical Officer, Saran, Chapra. Petitioner has demanded difference of pay of salary w.e.f. 01.01.2009 to 30.11.2011, pay of May, 2009 and Feb, 2010 as well as difference of Leave Encashment on the basis of last pay drawn by the petitioner. Counsel for the petitioner submits that petitioner was superannuated on 30.11.2011, thereafter he filed two representations dated 09.06.2017 and

Patna High Court CWJC No.23972 of 2018(2) dt.06-02-2023 2/2 20.07.2018 but authorities were kept mum on his representations.

Counsel for the State present and submits that a direction may be given to the petitioner to file a fresh representation before the Civil Surgeon (Respondent no.4) who shall pass speaking order within a fixed period of time. In this view of the matter, let the petitioner is directed to file a fresh representation raising his grievances in the writ petition as well as other grievances which has been developed during pendency of the writ petition within four weeks from today and the Respondent No.4 shall pass a reasoned order within six weeks thereafter.

With this direction, the present writ application is disposed off.
