This application for anticipatory bail arises out of Ghoshi P.S.Case No. 251 of 2017, disclosing offences under Sections 341, 323, 325, 308, 379 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that the co-accused Reema Devi, against whom there is allegation of having assaulted the informant's mother by a Garansa, has been granted anticipatory bail by this Court. He contends that there is general and omnibus allegation against these petitioners of assault. The injuries have been found to be simple, he contends.

Patna High Court Cr.Misc. No.790 of 2019(2) dt.25-01-2019 2/2 On perusal of the FIR, I find that the allegation of assault is not only against the co-accused Reema Devi, but against petitioner no.4 also.

However, considering the fact that the said co-accused Reema Devi has been granted anticipatory bail by this Court, this application is allowed. Let the petitioners, above-named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the Chief Judicial MagistrateI, Jehanabad in Ghoshi P.S. Case No. 251 of 2017, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
