Mother of the victim and victim are physically present in the Chambers of this Court. 3.

The petitioner seeks bail in connection with Bagha P.S. Case No.544 of 2023 registered for the offence under Sections 366(A), 376, 341, 323, 504, 506, 120B of the Indian Penal Code and Sections 4 and 8 of the POCSO Act. 4.

Allegation against the petitioner is to have kidnapped the minor daughter of the informant to perform marriage with her.

It is submitted by learned counsel appearing

Patna High Court CR. MISC. No.5207 of 2024(4) dt.08-04-2024 2/2 for both the parties that the matter has been compromised between the parties and victim has already been married with this petitioner, namely, Kushu Bin @ Keshu Kumar @ Kishu Bain.

Victim girl has also admitted before this Court that she has already been married with this petitioner. 7.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner and conceded the fact that victim has already been married with this petitioner. 7.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Bagha (Patkauli) P.S. Case No.544 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VIIth-cum-Special Judge, POCSO, West Champaran, Bettiah.
