The petitioner seeks bail in POCSO Trial No. 45 of 2019 arising out of Sugauli P.S. Case No. 278 of 2019 instituted for the offence under Section(s) 341, 342,323, 376/511 and 506 of the Indian Penal Code and Section 8/18 of the Protection of Children from Sexual Offencs Act, 2012.

It is submitted by petitioner's counsel that parties are in dispute since before, and as such, the petitioner has been implicated in this case on extraneous considerations. It is further submitted that recently the parties have compromised. The learned APP for the State opposed the prayer for bail by submitting that the offences are alleged against the victim who is aged 11 years. In her deposition recorded before the

Patna High Court CR. MISC. No.80003 of 2019(2) dt.05-12-2019 2/2 Court, the victim girl has supported the allegations. Considering the gravity of the offences, this Court, for the present, is not inclined to extend him the benefit of bail. Prayer for bail is rejected.
