2. The petitioners seek regular bail in a case registered for the offence punishable under sections Section 341 , 323 , 307, 302 and 34 of the Indian Penal Code .

3 . As per the prosecution case , on 23.06.2023 at about 12:00 pm, while informant was operating his mobile phone sitting in the orchard situated in front of his house , in the meantime all the F.I.R., named accused persons including these petitioners came there and demanded mobile phone from informant. When informant refused to provide his mobile , then

No.89906 of 2024(3) dt.11-04-2025 2/3 all the accused persons assaulted on head of informant and when his father came to rescue , the accused persons also assaulted on head of informant's father with iron rod and stick as a result of which , he sustained grievous injury . It is further alleged that on 28.06.2023 , informant's father died during course of treatment.

4. Learned counsel appearing for the petitioner submits that on the account of previous land dispute , a scuffle took place between the parties in which both sides sustained injuries. Case and counter case . Allegation of assault is general and omnibus in nature . The Post mortem report of the deceased revealed that no visible injury was found on the body of the deceased. Petitioners claim clean antecedent. Charge sheet has already been submitted. Petitioners are in custody since 21.09.2024 .

5 . Learned counsel for the State and informant oppose the prayer for bail.

6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioners is allowed. Let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st
