1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of regular bail, arises out of Daniyawn Police Station Case No. 72 of 2020, dated 30.04.2020, disclosing offences under Sections 147/148/149/323/307/504/506 of the Indian Penal Code and Section 27 of the Arms Act.

3. The prosecution case, on the basis of First Information Report, is that on the orders of co-accused Arvind Ram, the petitioner fired upon Prakash Chandra Rao due to which he sustained bullet injury near his nose.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to

Patna High Court CR. MISC. No.12470 of 2024(3) dt.12-07-2024 2/2 land dispute between the parties and from perusal of First Information Report it would be evident that there is previous enmity between them. Petitioner is in custody since 24.04.2023.

5. Regards being had to the submissions made by the parties and taking into consideration the period of custody i.e. since 24.04.2023 and the nature of allegation against the petitioner, I am inclined to grant regular bail to the petitioner.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional District and Sessions Judge-IV, Patna City, in connection to the Daniyawn Police Station Case No. 72 of 2020.
